Terms of Service

1. About Pep Pushers

Pep Pushers (“we,” “us,” or “the Network”) is a private affiliate and influencer marketing network that connects content creators, recruiters, and brand-managers with brands that sell (a) research-use-only peptide products (“research products”) and (b) prescription peptide and wellness products dispensed through compliant telehealth providers (“telehealth products”). These Terms govern your access to and use of the Pep Pushers platform, website, and related services (collectively, the “Service”).

2. Eligibility

  • You must be at least 18 years old to create an account or participate in the Network.
  • You must have the legal capacity to enter into a binding agreement in the jurisdiction where you reside.
  • Accounts are personal and non-transferable. You may not create an account on behalf of another individual without explicit authorization.
  • We reserve the right to refuse or terminate accounts at our sole discretion, including for compliance violations.

3. Acceptable Use

You agree to use the Service only for its intended purpose: marketing research-use peptide products and compliant telehealth services through disclosed, honest promotional content.

You may NOT:

  • Make medical, therapeutic, diagnostic, or cure claims about any product promoted through the Network. Research products are sold strictly for research purposes; telehealth products require a valid provider-patient relationship and licensed prescription.
  • Imply that any product is approved by the U.S. Food & Drug Administration (FDA) unless that approval exists and is verifiable.
  • Use spam, fake engagement, misleading captions, or deceptive advertising practices in any promotional content.
  • Fail to disclose your paid affiliate relationship in any promotional content. All disclosures must be clear, conspicuous, and comply with FTC guidelines (16 CFR Part 255) — e.g., “#ad,” “paid partnership,” or “I earn a commission.”
  • Share, sell, or transfer your affiliate links or discount codes in bulk coupon aggregation sites or in ways designed to circumvent attribution.
  • Violate any applicable federal, state, or local law, including but not limited to the FTC Act, DSHEA, EKRA, and state consumer-protection statutes.
  • Attempt to reverse-engineer, scrape, or interfere with the Service's technical infrastructure.

4. Research-Only Products

Research-use peptide products offered through the Network are sold strictly for laboratory and in-vitro research purposes and are not intended for human or animal consumption. By promoting these products, you acknowledge this limitation and agree to restrict all marketing language accordingly. Dosing, weight-loss, appetite-suppression, or other human-use claims are strictly prohibited.

5. Telehealth Products

Telehealth brands on the Network offer prescription products through licensed providers. Compensation for promoting telehealth brands is structured as flat, non-volume-based fees to comply with the Eliminating Kickbacks in Recovery Act (EKRA) and applicable anti-referral laws. Per-patient and per-prescription percentage-based commissions are not permitted on telehealth brand promotions. You agree to use only brand-approved, fair-balanced copy for telehealth content.

6. Your Account and Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are fully responsible for all activity that occurs under your account, including all promotional content published using your affiliate links or codes.
  • You agree to notify us immediately at support@peppushers.com of any unauthorized use of your account.

7. Termination

We may suspend or terminate your account at any time for any violation of these Terms, the Affiliate Agreement, or applicable law — including but not limited to FTC disclosure failures, illegal health claims, or compliance violations. Termination does not relieve you of any obligations incurred prior to termination, including outstanding FTC disclosure duties for live content.

8. Intellectual Property

The Pep Pushers name, logo, and platform design are proprietary. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended marketing purposes. You retain ownership of original content you create; you grant us a limited license to reproduce it for platform, audit, and compliance purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEP PUSHERS AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, COMMISSIONS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Pep Pushers and its owners and operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your promotional content, your violation of these Terms, or your violation of any applicable law.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Florida, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via the platform. Continued use of the Service after the updated Terms are posted constitutes acceptance of the revised Terms.
